Kia ora

1. At the bottom, add the contact:

    Larn Wilkinson 07 862 7922

2. Agenda/Kaupapa part, amend the para "If the hui, agrees...." to

"If the hui agrees, it will also elect two interim negotiators and discuss, and vote, if necessary, on related issues such as alternate negotiators, accountabilities and structure for negotiations."

3. The last paragraph of the draft ad is definetly not the same wording as the previous Tamatera hui. It appears to introduce new eligibility criteria that were not imposed by the Crown in relation to previous Hui A Iwi of Tamatera and other hui. This is unreasonable and unfair particularly given it was never discussed. I think we would be happy for the eligibility component to revert back to the original Tamatera ad in preference to the current drafting. Our sign off is subject to receiving a copy of that original ad to enable us t o compare and confirm that.

When we receive a copy of the original ad we can sign off the amendment. There are no other amendments from the Runanga spokesperson so therefore it would then be good to go subject to the above. I appreciate that you are not in the office but there must be some way of getting a copy of the original to us as a matter of urgency.

If the Runanga spokesperson makes any further changes then we want to be provided with a copy in order to approve any further changes. A final circulation with all amendments for sign off would be the best way.

Liane

Tob y or Kererua please forward with urgency the previous public notice that was advertised for the Tamatera Hui A Iwi in November and December last year so that I can compare.
>
> I note Larns comment around the deadlines for the NZ Herald so the 10am deadline does seem to be arbitrary. When I asked at the meeting this week whether 10 working days included weekends I was advised that yes it did. If that is the case then the Weekend deadline is not that stringent although it would be good to give as much notice as possible. It is important that we get the wording right.

>
> I understand the Marae Chairs concern regarding the Runanga Chair. You successfully get the resolutions the Crown needs and that is it. The remainder is for Tamatera to determine in accord with Tamatera kawa. I am glad this has been acknowledged.
>
> As I advised at the hui, in my view the arrangements at the marae for the hui are best left with our marae. I am aware that Uncle Tewi is a trustee (and also a kaumatua trustee of the Runanga) and that Larn is the current Chair (and also a member of our committee). It seems the interests of both Tamatera factions (as you have previously called then) are met working through our marae. I would however await the view of the marae as to whether they are willing to manage this hui arrangement and to receive confirmation as to the availability of the marae.
>
> Then that leaves the wording of the advertisement which was not agreed upon at the hui. Thanks for the draft. Our committee will look at it and make any amendments if required. Toby can you please advise when you need any amendments by.

> Yesterday afternoon I was phoned by Larn Wilkison who I understand is the interim marae chair for Te Pai o Hauraki. Larn was concerned that I had decided the hui must to be chaired by the Runanga and that this involved a unilateral imposition on my part and trod on Ngāti Tamaterā kawa. Larn made it clear to me that he expects as interim marae chair to be opening and closing the hui.
>
> This is a matter on which I have no strong view, and it is not a matter for me to decide. I want to stress that I did not impose a decision on Runanga being chair for the hui but followed the consensus from yesterday's hui which included Uncle Tewi. I have be en a Crown agent in the Māori world for almost two decades and I am well aware of where the limits of my proper authority and influence lie.
>
> As for the specific issue, it is important that this issue does not distract from the common objective which is to ensure Ngāti Tamaterā holds a successful hui and is able to elect two interim negotiators to join the negotiators if that is the will of the people. I am confident that the Runanga and the interim marae chair will liaise to resolve this issue in a mature and respectful way that accords with Ngati Tamatera kawa.

> I have been advised by the Runanga that the attempt to arrange a small group to organise a mandate hui was not successful in that only one side showed up. The Runanga has confirmed it does wish to proceed with a third attempt to hold an interim mandate hui as requested by the Crown and as seven other Hauraki have already done. Nine Iwi are now participating in the Collective and are making very good progress. Ngāti Tara Tokanui will be holding a second interim mandate hui this Sunday. I am concerned to ensure that as soon as possible, all 12 Hauraki Iwi have the opportunity to participate constructively in the Collective negotiations if that is their wish.
>
> I also met yesterday with Liane and Lane and four Ngāti Tara Tokanui and Ngāti Hako Iwi members and confirmed that the Crown's expectation is still that each Iwi will hold one hui at which two interim negotiators will be appointed to attend and participate in the Hauraki Collective. That is, the hui will elect the interim negotiators.
>
> I would therefore like to convene a meeting next week in south Auckland at which the logistical arrangements for the Ngāti Tamaterā interim mandate hui will be agreed and arrangemen ts put in place to lodge publicity etc. I would like this hui to take place next Tuesday 13 April at 9.30 am. Te Puni Kōkiri will advise the venue.

DATED August 2009 For Marutūāhu Working Group For Hauraki Māori Trust Board ________________________________________________________________________

FW: Today's Meeting with HMTB

Tena tatou

Today’s meeting with the HMTB representatives was very disappointing.

At the MWG meeting before the arrival of the HMTB representatives, it was agreed to listen to their korero and to then table a draft model of what a joint approach might look like (but which would need final approval from the MWG).

After discussing some preliminary matters with the HMTB representatives, we tabled the attached draft document.

In response, John McEnteer put forward the HMTB’s proposal which was as follows:

  • There be a separate entity to represent “all the people of Hauraki”
  • The entity would comprise:
  • Toko Renata
  • Harry Mikaere
  • John Linstead
  • John McEnteer
  • Russell Karu
  • The entity would also include two “Marutuahu people” but only if they are elected by a postal ballot.

Unsurprisingly, the MWG members in attendance at the meeting were very disappointed with the insulting nature of HMTB proposal and the meeting did not proceed very far at all.

The next step is that the HMTB representatives will consider the draft MWG proposal and advise within the week whether or not there is any common ground.

If the HMTB representatives advise there is nothing more to discuss, the next step would be to urgently meet with the Crown representatives to attempt to agree a MWG process for going forward.

The struggle continues .... kia kaha

Paul Majurey: Two-way Crown view adds to Treaty delay

Crown officials have been dogged by wide-ranging criticism of their Auckland negotiations with Ngati Whatua since they began in 2003. But, proving there is no monopoly on ineptitude, some Hauraki Maori Trust Board representatives have rejected a Crown offer to urgently start, and fund, long-awaited Treaty negotiations with the Marutuahu and other Pare Hauraki tribes. The rohe (customary area) of the Marutuahu and other Pare Hauraki tribes encompasses about 810,000ha between Matakana Island near Tauranga in the south to Matakana near Leigh in the north. This is the ancestral home of more than 15,000 people, nearly 80 per cent of whom belong to the Marutuahu iwi of Ngati Maru, Ngati Whanaunga, Ngati Tamatera and Ngati Paoa. The other related iwi of Pare Hauraki descend from various waka. The Waitangi Tribunal has added: "The traditional history of Hauraki is dominated by the invasion and settlement of much of the region by iwi collectively known as Marutuahu ... the Marutuahu 'empire' was largely maritime-based." These tribes have experienced two very different Crown images in recent years. Its benign face belongs to the Office of Treaty Settlements team managing the Treaty claims of the Marutuahu and other Pare Hauraki tribes. It methodically laid a platform for the offer to urgently commit Crown resources and ministerial priority to negotiate a comprehensive Treaty settlement The Crown recently advised the Waitangi Tribunal of "the two main representative bodies that have been the focus of Office of Treaty Settlements' work in the Hauraki district - the Hauraki Maori Trust Board and the Marutuahu Working Group." The Crown's only condition for progressing this Treaty settlement process is that both groups agree to work together during negotiations. Most on the Hauraki board won't; all the Marutuahu Working Group will, having received an overwhelming mandate to represent the four Marutuahu tribes along with Te Patukirikiri and Tumutumu of Pare Hauraki. The rationale for a joint approach is underscored by the Crown's recent decision to withdraw its mandate recognition of the governance body for the Te Ati Awa because of "infighting". To regain mandate recognition and recommence the settlement process, the people of Te Ati Awa - whose rohe includes areas of Taranaki - will need to go back over some old ground. The Crown's malevolent face is the Office of Treaty Settlements' group behind the decision to offer exclusive rights (to Ngati Whatua) for the Crown's cultural and commercial assets in central Auckland and the Devonport naval housing portfolio - this despite the recorded customary interests of the four Marutuahu iwi throughout the Auckland isthmus and North Shore. It was this type of inexplicable Crown favouritism which prompted the recent Waitangi Tribunal inquiry hearing. The report from that is expected to be published in early May and may lead to the Crown having to dump its controversy-prone Treaty negotiations policy and practice. Janus-like, the Crown projects itself in opposing directions. Its misconceived decision to pick a winner may see the Ngati Whatua deal carted back to the repair shop. Conversely, the Crown's commitment to a joint iwi approach as a bridge to urgent negotiations has exposed those few Hauraki board representatives who covet a monopoly on power ahead of an inclusive and enduring Treaty settlement for a landless people A summary of the Hauraki negotiations impasse shows:* 2005: The Marutuahu Group and Hauraki board hold widespread mandating hui as most people of Marutuahu and Pare Hauraki descent live in urban centres between Auckland and Wellington. The two groups subsequently file applications to have their negotiations mandates recognised by the Crown (a required precursor to Treaty negotiations). * June 2006: The Waitangi Tribunal releases its Hauraki Report confirming significant Treaty breaches by the Crown against the Marutuahu and other Pare Hauraki tribes. The common denominator for its various findings is the systematic acquisition of land by the Crown, including via raupatu, which led the Tribunal to confirm: "The fact that Hauraki Maori have lost more of their land than most iwi [and] it was not only that [they] lost nearly all their land. It was the manner of losing it that divided and pauperised them." * October 2006: The Treaty Minister and Maori Affairs Minister decline the separate Marutuahu Group and Hauraki Board mandate applications, instead foreshadowing the call for a joint approach. As the ministers consider recognising two separate mandates could worsen internal relationships, they recommend "further steps should be taken to promote co-operation and unity among the claimant groups". * February 2007: The Marutuahu Group and Hauraki Board meet with the ministers and officials. While Marutuahu agree to work together with the Hauraki Board, some board representatives declare the Crown must negotiate with it alone. The ministers refuse, however, to overturn their October decision. The Hauraki Board's retort following the year-long Landcorp deferral on the sale of the Whenuakite Station was to seek a comprehensive remedies hearing before the Waitangi Tribunal. The board hoped this would force the Crown to negotiate solely with it. However, the Tribunal rejected the Hauraki Board's application mainly because of Office of Treaty Settlement evidence confirming the Crown's promise of funded, urgent negotiations with both groups. Wanting to break the impasse, some Hauraki Board representatives moved resolutions at a recent meeting to work together with the Marutuahu Group, but the motion was defeated by three votes. While a handful of Hauraki Board representatives try to stare down the Crown away from its joint approach, the Marutuahu and other Pare Hauraki tribes are prevented from even starting negotiations on the five-year-plus road to a Treaty settlement. While this stasis remains locked in at the behest of a few, the landlessness continues, the opportunity costs escalate - from deferred transfer of settlement assets - and the Crown stands ready to send these claims to the back of the queue. * Paul F. Majurey is a lawyer who belongs to all the Marutuahu tribes and represents them in both the Tamaki Makaurau Inquiry and Hauraki Treaty mandate negotiations.

This is a trial setup to create a smarter way of communicating with tangata that are interested in the affairs of the Marutuahu Tribes ...
